Jeff - thanks for the reminder about Blue Jeans Cable and the great story, can't wait to see how it turns out.

I needed some HDMI cables and was appalled at what their prices. Then I remembered your posting about these guys. I ordered from them and I got the shipment 2 days later (from Washington state to NJ, not bad!)

[...] As I mentioned a few minutes ago, the CEO of Blue Jeans Cable, a former litigator, responded pretty forcefully to a cease and desist letter from Monster Cable, alleging various forms of infringement. One of the things I liked about the Blue Jeans response was its detailed requests for additional information — “If you expect to persuade me, you had better start making full, open and honest disclosures; I will find out the facts sooner or later in any event ….” (Emphasis added; hat tip Jeff Nolan at Venture Chronicles.) [...]

I like his detailed requests for additional information -- "If you expect to persuade me, you had better start making full, open and honest disclosures; I will find out the facts sooner or later in any event ...."

When I was a general counsel, an approach that worked really well (I only used it with claimants who seemed like serious people) was more or less the following: Let's put an NDA in place, and I'll give your lawyer whatever s/he wants to look at that we can conveniently collect, as long as you agree to do the same. If litigation were to come to pass, we'd exchange the information in discovery under a protective order in any case. So let's do it now, informally, in the hope of avoiding the expense.
